Lawsuits claiming that gender, age or disability discrimination caused an employee’s demotion cannot circumvent statutes of limitation by invoking a 2009 law that triggers a new claim each time a paycheck is issued, the U.S. Court of Appeals for the Second Circuit ruled Tuesday.

Natasha Davis sued her employer in Davis v. Bombardier Transportation Holdings (USA), 12-289, alleging she was the victim of disability discrimination when Bombardier Transportation Holdings demoted her after she returned to work following eye surgery.
