Two Rockland County property owners cannot be held responsible for an incident in which their tenants’ associates attacked a neighbor who had called the police to break up a party at the property, an appellate court has ruled.

The decision by the Appellate Division, Second Department, in Taggart v. Costabile, 3435/10, reverses an order by Acting Rockland County Supreme Court Justice Thomas Walsh to deny a motion filed by property owners Ralph and Andrew Costabile to dismiss a complaint filed by John and Dawn Taggart, who are seeking damages from the Costabiles for negligent infliction of emotional distress and other claims.
