ESTATE OF JERRY CASTELLONE, a/k/a GENNARO J. CASTELLONE, ETC., ap, v. JP MORGAN CHASE BANK, N.A., ETC. RESPONDENTS def — (INDEX NO. 2620/06)In an action, inter alia, to recover damages for breach of contract, the plaintiff appeals from an order of the Supreme Court, Suffolk County (Pitts, J.), dated September 16, 2013, which denied its motion for leave to renew its opposition to that branch of the defendants' motion which was to compel the plaintiff to arbitrate, which had been granted in an order of the same court dated March 24, 2008, as modified by decision and order of this Court dated March 3, 2009, to the extent of directing the plaintiff to arbitrate its claims insofar as asserted against the defendants JP Morgan Chase Bank, N.A., and its predecessors, Chase Investment Services Corp. and JP Morgan Chase & Co.
