Sanctions against defendants and their attorney were unanimously affirmed last week by the Appellate Division, First Department, in the long-running case, AQ Asset Management v. Levine, 652367/10, in which it has issued three prior rulings.
Justice Shirley Werner Kornreich of Manhattan’s Commercial Division sua sponte imposed the sanctions against defendants Hapsburg Holdings Ltd. and Osvaldo Patrizzi, and their attorney Kerry Gotlib, in rulings a year ago.
