Revoking a convicted murderer’s parole because his dementia made him incapable of reporting his change of address as his parole conditions required was “incomprehensible,” a Bronx judge ruled in granting the man’s habeas petition.

Justice Richard Price‘s opinion Friday in Fortunato v. Department of Corrections, 250019/14, found that Virgilio Fortunato had been denied due process because he was unable to represent his interests or assist his counsel at his parole hearing.
