An auto racing track may be sued for negligence even though the injured plaintiff signed a waiver before entering the track to act as a member of his daughter’s pit crew, a judge decided.

The release, signed by George Stevens, absolved the Skyline Raceway and its owner, Franklin Payne, of liability for injuries related to what the release warned is the “very dangerous” sport of sprint car racing. The release also said Stevens assumed the risk of injury or death “arising out of or related to the events” at the Skyline Raceway in Cortland.
