ESTATE OF EARL ALFRED LOOMIS, JR., a/k/a EARL A. LOOMIS, JR., Deceased. (11/2673/B/C) — In this final accounting proceeding, covering the period May 10, 2011 through August 31, 2013, petitioners are the co-executors of the estate, letters testamentary having issued to them on August 3, 2011. Petitioners seek a decree (a) judicially settling their account; and (b) construing Article SEVENTH(G) and TENTH(B) of decedent’s last will and testament dated June 10, 1999 to read that, upon the death of decedent’s wife, Muriel Peabody Loomis, one hundred percent of the remaining trust assets be distributed, on a pro rata basis, to the individuals named in paragraph TENTH(B) of decedent’s will; and (c) allowing the payment of the executors’ commissions in the sum of $24,141.26 to the estate of Patrick Noel Moloney, who died on May 14, 2014.

Jurisdiction has been obtained over all persons listed in the petition as necessary parties. A guardian ad litem was appointed to represent the interests of decedent’s infant and unborn contingent beneficiaries. Objections to the accounting were filed by the Attorney General of the State of New York on July 15, 2014. The Attorney General objected to the account in that it did not include Schedule “I,” and also objected to the construction proposed by the co-petitioners.
