Second Circuit judges who argued against allowing the European Community to pursue civil racketeering claims against RJR Nabisco for an alleged global money laundering conspiracy have lost their bid to have the full court decide the issue.

A majority of the circuit’s active judges have voted against rehearing en banc the case of European Community v. RJR Nabisco, 11-2475-cv, which charges that drug money from organized crime groups was laundered through the exchange of discounted euros and cigarettes in Europe.
