Evidence was sufficient to convict a man of identity theft and making a terroristic threat for threatening in an email to kill then-governor David Paterson, an appeals court has decided.
The Appellate Division, Third Department, judges also unanimously decided in People v. Rizvi, 104624, that the concurrent sentences Amir Syed Rizvi received from Albany County Judge Stephen Herrick of 4 years for the terroristic threat conviction and 2 1/2 to 7 years for identity theft were “reasonable in light of the serious nature of the crime.”
