Despite a prenuptial agreement that one justice said “failed to achieve its intended purpose,” a unanimous panel of the Appellate Division, First Department, said a man was not required under it to make a $950,000 payment to his ex-wife.

The panel affirmed the ruling of Acting Justice Lori Sattler in Buckingham v. Buckingham, 314297/11, with four judges saying that the prenup provision was “plain and unambiguous” in providing for a payment only if the husband sold the entire company or one of its subsidiaries or related companies.
