THE GUARDIANSHIP OF CODY D. H., an Infant (09/1098) — In this infant guardianship proceeding, by decree dated June 3, 2009 the infant’s father was appointed guardian of the infant’s property, which then consisted of proceeds of life insurance issued under a policy insuring the infant’s mother who died on February 2, 2009.

Although the decree directed the deposit of any proceeds in the name of the guardian jointly with the Guardian Clerk of this court, subject to further order of this court, it appears that the guardian of the infant’s property never came to court with the check to be endorsed and, to date, has failed to file annual accounts (SCPA 1719). Written inquiries by the court to the guardian of the property and to the life insurance company as to whether a check ever issued to the guardian of the infant’s property, have remained unanswered. Although in his petition for guardianship the father indicated that the infant lived with him and his mother, the infant’s paternal grandmother, the infant has advised the court’s guardianship department that he was raised by his maternal grandmother, neither he nor she knew anything about the life insurance policy amount, and he has had no dealings with his father’s side of the family. It appears that the infant will reach the age of majority on September 27, 2015.
