New York State’s Division of Human Rights has been ordered to pay legal fees to a New York City co-op for botching a disability discrimination claim brought by a tenant threatened with eviction over her pit bull, “Rosie”.

Manhattan Supreme Court Justice Cynthia Kern (See Profile) ruled in East River Housing Corp. v. New York State Division of Human Rights, Index No. 102237/13, an Article 78 proceeding, that East River is entitled to legal fees for its successful claim that DHR had improperly vacated its own finding dismissing the discrimination claim of dog owner Stephanie Aaron.
