ALBANY – An upstate appellate court has refused to enforce a “no contest clause” in a will because doing so would subvert the overall intentions of the decedent.

Matter of the Estate of Prevratil, 517693, centers on the last will of Frank Prevratil, who owned the Triangle Agricultural Enterprises Horse Farm, a horse sanctuary in Columbia County. At issue was a provision disinheriting anyone who challenged anything in the will.
