A federal judge in Buffalo has declined to rule on whether the Telephone Consumer Protection Act (TCPA) applies to debt collectors or only traditional telemarketing operations.
Western District Judge John Curtin (See Profile) said that with courts divided on the issue, the lack of any controlling authority—and the fact that the Federal Communications Commission is expected to issue clarifying regulations—there’s no point in the court weighing-in just yet.
