A claim by conservative commentator Dinesh D’Souza that he is being selectively prosecuted on campaign contribution violations for criticizing President Barack Obama was rejected Thursday by a federal judge.

Southern District Judge Richard Berman (See Profile) denied D’Souza’s motion for discovery in anticipation of a motion to dismiss at an afternoon hearing. Berman’s decision cleared the way for D’Souza’s trial next week on charges of campaign finance fraud and false statements for having two friends and their spouses each contribute $10,000 as “straw men donors” to New York Republican Senate hopeful Wendy Long—and then almost immediately reimbursing them.
