The Southern District is considering a rules change on the assignment of cases to judges when there is a superseding indictment.
Chief Judge Loretta Preska (See Profile) said Monday the Criminal Law and Rules Committees were working on the issue before Second Circuit Judge Barrington Parker (See Profile) raised it on April 22 in the appeals of convicted insider traders Todd Newman and Anthony Chiasson.
