The state Court of Appeals will hear oral arguments on June 4 over New York City’s attempt—scuttled by two courts during the administration of former mayor Michael Bloomberg—to restrict the sales of sugary drinks in containers larger than 16 ounces.

Mayor Bill de Blasio is continuing to pursue the measure before the state’s highest court. Manhattan Supreme Court Justice Milton Tingling Jr. and a unanimous Appellate Division, First Department, panel both held that Bloomberg’s Board of Health overstepped its authority when it imposed the ban as part of an anti-obesity public health campaign (NYLJ, July 31, 2013).
