The U.S. Supreme Court has declined to hear a challenge to a court-approved settlement in a case where New York City tenants claimed their landlord fraudulently increased rents and harassed them.

The court on Monday denied a writ of certiorari to tenants who objected to the settlement, complaining there should have been separate legal counsel to push for inclusion of their claims. Tenants living in buildings that were managed and owned outright or in part by Pinnacle Group sued Pinnacle in the Southern District in 2007, alleging RICO violations and breaches of state law under General Business Law §349(a) forbidding deceptive business practices.
