Grocery delivery service FreshDirect can build a new headquarters in the South Bronx, a unanimous Appellate Division, First Department panel ruled Thursday, upholding the dismissal of an Article 78 petition brought by a coalition of neighborhood activists.

The petitioners’ suit, filed in 2012, alleges the city’s Industrial Development Agency (IDA) approved the development without adequate environmental impact reviews. They have raised concerns that FreshDirect’s trucks, which will be based at the new headquarters and dispatched to deliver groceries to customers throughout the city, will worsen traffic, noise and pollution.
