Credit reporting agency Experian Information Solutions Inc., must go to trial in a lawsuit brought by a Bronx woman who claims the company failed to investigate her disputes of items on her credit report that she says resulted from identity theft, a Manhattan federal judge has ruled.

Southern District Judge Colleen McMahon (See Profile) held in her Nov. 12 decision in Jones v. Experian, 1:11-cv-09136, that Experian had not complied with its obligation under the federal Fair Credit Reporting Act (FCRA) as a matter of law by simply verifying the disputed debts with the creditors. The judge also ruled that the plaintiff, Keisha Jones, had standing to bring the suit even though she is not alleging any actual damages.
