A child conceived by a prison guard who was impregnated by an inmate facing the death penalty has been deemed neglected by a judge who said the mother’s actions went “well beyond what could possibly be considered ‘undesirable parental behavior.’”

“So egregious is the nature of Nancy G.’s criminal acts, that she conceived the child with the knowledge that he would be neglected and left to suffer emotional hardship and stigmatization, that the Court is left with ample ground to bring the consequences of Nancy G.’s actions to fruition and adjudicate the child to be neglected within the full meaning of the Family Court Act,” Suffolk County Family Court Judge David Freundlich (See Profile) wrote in Matter of Justus G., NN-15689-13.
