A Brooklyn appellate panel has reinstated a one-year license suspension imposed on a Vestal woman who fell asleep while driving on Route 9 in Putnam County and caused a head-on crash that killed an 81-year-old motorist. The penalty imposed by the state Department of Motor Vehicles on Teresa Kenny, 54, had been reduced to 60 days by Dutchess Supreme Court Justice James Brands (See Profile).

Kenny successfully argued that the year-long suspension was disproportionate to the offense on the grounds that there was no finding of gross negligence, that she has a spotless driving record and would likely lose her job as district manager for a major retail company if she couldn’t drive for a year.
