An attorney who unsuccessfully ran for state Supreme Court in 2009 has been censured for making a false statement in federal court. Jill Dunn was disciplined Thursday by an Appellate Division, Third Department, panel upon recommendation of the department’s Committee on Professional Standards in Matter of Dunn, D-56-13.

The court said its action was based on a decision in the Northern District by Magistrate Judge David Homer (See Profile) related to the federal securities fraud case S.E.C. v. Smith, 798 F. Supp 2d 412 (2011), in which Dunn represented a family trust established by defendant David Smith. Smith and former partner Timothy McGinn were convicted of defrauding hundreds of investors out of tens of millions of dollars in a Ponzi-like scheme.
