Wife sought pendente lite maintenance requiring all compensation paid by company A. Management Corp. (AMC) to both parties to be equal. She also sought temporary maintenance award, among other things, in this divorce action. Husband opposed arguing wife left voluntarily and was receiving a salary from AMC, and his monthly payments for various expenses, including her cell phone and car insurance. He also claimed that while AMC continued to pay wife a salary, and other benefits, she has not worked for AMC in nearly four years. The court denied wife’s request for pendente lite maintenance requiring all compensation by AMC to both parties be equal, noting such relief was not authorized by the court attorney referee, nor would the court be inclined to make such an order as wife has had no active role in the company for nearly four years. It also stated the presumptive award of temporary maintenance was $9,824.60 annually, but found same unjust and inappropriate, ruling no temporary maintenance award was appropriate. The court stated wife has been receiving a salary from AMC, supporting herself on such income and husband was making voluntary payments on her behalf exceeding the presumptive award.
