ESTATE OF ARTHUR PRESENT, Deceased (337/A/12) — On the return date of this compulsory accounting proceeding in which the petitioner also requested additional relief, the respondent administrator appeared and consented to the entry of a 45-day order. Based upon this state of the record, the application is granted.

Accordingly, the respondent is directed to file his account, a petition for its judicial settlement, and all of the papers required to obtain the issuance of a citation in the accounting proceeding within 45 days of the service upon him of a certified copy of the order to be entered hereon. The respondent shall then, without delay, cause the citation to be served upon all parties required to be served in an accounting proceeding pursuant to SCPA 2210. The respondent shall appear before the court from time to time as required for the purpose of the settlement of his account. The branch of the petition seeking additional relief was adjourned to December 3, 2013.
