Tenant Revander moved to vacate judgment of possession and warrant of eviction. Landlord commenced a nonpayment summary action seeking payment of rent arrears. Tenant was the recipient of benefits under the Family Eviction Prevention Supplement (FEPS) program of New York City Human Resources Administration, and public assistance was authorized to make partial payments of tenant’s rent directly to landlord on Revander’s behalf. Landlord and tenant entered into a stipulation of settlement in which Revander consented to the issuance of a final judgment of possession and rent arrears. After numerous orders to show cause and additional stipulations, landlord argued vacatur should be denied as Revander entered into them knowingly and voluntarily and should not be permitted to disavow same. The court agreed stating Revander failed to show a sufficient cause to invalidate any of the stipulations or vacate final judgment and warrant of eviction. It found no grounds to relieve tenant from the consequences of the bargained for stipulations, which the court oversaw, reviewed and gave its approval. Revander’s motion was granted only to the extent of granting her an extension to pay her rent arrears.
