A Manhattan landlord can evict an elderly rent-stabilized tenant whose clutter has become a hazard to other tenants, but must first give him several months to remedy the situation in light of his age and health, a Manhattan housing court judge has ruled.

Judge Timmie Elsner (See Profile) ruled on Oct. 10 in 443 East 78th Street Realty v. Tupas, 053159/13, that the tenant, Reuben Tupas, has until Feb. 28 to cure the hazardous condition. At that time, he can move for a stay of eviction or other relief.
