A police force established on upstate Indian land has no jurisdiction off the reservation, a judge has held in dismissing a felony drunken driving indictment in Franklin County.
Supreme Court Justice Robert Main Jr., in a matter of first impression, held that the police power of the St. Regis Mohawk Tribal Police Department is restricted to criminal conduct within the borders of the Akwesasne reservation. Main said he had no choice but to dismiss an indictment charging Amanda Herne with two felonies, DWI and aggravated DWI.
