A judge overruled a city agency’s decision to terminate an ailing paraplegic man’s rental subsidy, saying the man was entitled to a hearing about the denial even though he missed a hearing request deadline by seven days.

“Petitioner’s request for an informal hearing filed seven days late, is not unreasonable given his physical condition and the severity of his health problems,” Manhattan Supreme Court Justice Manuel Mendez (See Profile) wrote in Matter of Bryan v. New York City Department of Housing Preservation and Development, 400427/13, reinstating the rental subsidy and remanding the matter for an administrative hearing.
