A lawyer’s claim that she was fired as assistant Cayuga County attorney because of the absences from work she took under the Family and Medical Leave Act can proceed, a federal judge decided Monday.

Northern District Judge Lawrence Kahn (See Profile) denied the county’s motion for summary judgment in Terry v. County of Cayuga, 5:11-cv-1296. He concluded Jill Terry’s claim of illegal termination contained sufficient facts to show that her boss had “repeatedly and explicitly” expressed hostility toward her for taking leave.
