I heard an eye-opening statement from a client recently when I noted in a presentation the importance of keeping good records and continually monitoring those records to keep the paperwork in order. The client said the "pledge of allegiance" as to my suggestions, but also said that his ability to keep accurate records was a function of available resources, which he seemed to lack. When it comes to legal spends, especially for activities not directly related to revenue production, the "budget" almost always enters the discussion, and I can appreciate that.
Of course, when the legal problem is a bet-the-company issue, the concept of budget often goes out the window. I can understand that. An intelligently led company will have little choice but to pay a lawyer whatever the price may be for legal assistance in this circumstance.
