ESTATE OF LEO MESSINA, ALSO KNOWN AS LEO J. MESSINA, Deceased (2746/E/11) — On the initial return date of this proceeding by the executor seeking to judicially settle her account an attorney appeared on behalf of three potential objectants and sought to conduct SCPA 2211 examinations. The court directed the executor to submit to the SCPA 2211 examination to be held on July 9, 2013 (Matter of Messina, NYLJ, June 26, 2013, at 22, col 5). Prior to the examination, counsel for the executor moved by order to show cause seeking to be relieved and the examination was stayed. On the last adjourned date of the order to show cause, a formal substitution of counsel was filed with the court, rendering academic the order to show cause. Counsel for the potential objectants requested that the stay of the SCPA 2211 examination be lifted and that the examination occur on September 19, 2013. Upon consent of incoming counsel, the court granted the request. Accordingly, this decision constitutes the order of the court denying the order to show cause and motion as “academic”, and restoring the accounting proceeding to the court’s calendar of September 19, 2013 as a control date. Absent a formal settlement prior to that date, the executor is directed to submit to the SCPA 2211 examination to be held in Room 328 of the Surrogate’s Court on September 19, 2013.

The Chief Clerk shall mail a copy of this decision and order to respective counsel.
