A federal appellate court has upheld the dismissal of a high-profile civil rights suit against Suffolk County. The U.S. Court of Appeals for the Second Circuit issued an unsigned summary order on Monday affirming a ruling by Eastern District Judge Leonard Wexler (See Profile) who determined that Suffolk County was not properly served in the $40 million suit.

Ecuadorian immigrant Marcelo Lucero was fatally stabbed by teenagers in a Village of Patchogue parking lot. His estate administrator, Luis Almonte, sued the county and other municipalities, claiming the entities knew, but did nothing to address, local anti-Hispanic animus.
