Farage moved for leave to renew and renew a prior court order, and upon renewal, denial of attorney Ehrenberg's motion for summary judgment, among other things. Ehrenberg cross-moved for sanctions against Farage for engaging in frivolous litigation practices. Farage sued Ehrenberg for legal malpractice stemming from his representation of her in a prior personal injury action. That action was settled, but Farage sought to set it aside. A Judicial Hearing Officer denied the motion finding Farage failed to sustain her burden of proving the stipulation was fraudulent or a mistake and should be held invalid. Ehrenberg's motion for summary judgment dismissing the complaint as barred by the statute of limitations was granted. Farage disputed the finding asserting her complaint was filed within the three year limitations period, but the court disagreed, denying Farage's motion for reargument on the ground she failed to establish the law was misapplied or any relevant facts were overlooked. However, the court also denied Ehrenberg's motion for sanctions against Farage for her renewal motion finding they were unwarranted, and noted Farage's conduct was not frivolous or undertaken to harass or injure Ehrenberg.
