Justice Colleen Duffy

Plaintiff and defendant were married in 1990 and had two children. The parties later divorced and plaintiff sought an order declaring defendant in contempt of court for willful violation of the terms of the Judgment of Divorce. Plaintiff also sought a money judgment against defendant for child support arrears, disability pension arrears, and certain medical insurance reimbursements allegedly taken by defendant. The court denied plaintiff's application for child support arrears, finding no merit to plaintiff's contention that defendant has defaulted in his child support obligations to the child in plaintiff's custody. The court also denied plaintiff's application to vacate a Qualified Domestic Relations Order, finding that plaintiff is not entitled to receive more than half of the marital portion of defendant's disability pension. The court granted plaintiff's application for $1,040 for medical reimbursement checks which she claimed were mailed to defendant and which he allegedly withheld from her, to the extent that the court directed the defendant to request re-issuance of the checks from the insurer and, if re-issuance is denied, defendant must reimburse plaintiff for the value of the checks.
