Gross filed this action under Election Law §16-102(1) seeking to declare valid a designating petition for his candidacy as Mayor of the Village of Spring Valley. Schneider objected to various signatures on Gross' petitions claiming the addresses of the signers were improper or inaccurate, claiming the signature entries had an invalid address as the one given did not exist in the subject zip code. The court found respondents' reliance on §§6-130 and 6-132 was misplaced and inapplicable to village elections. It stated the information required on a designating petition for a candidate running for a public office in the village did not require the signer to indicate their town or city of residence as such signer was required to reside within the village in order to vote in the village election. The court stated §6-204, governing the form of designating petitions for elective village offices, provided that such petitions should contain signatures of residents in the village who were registered to vote at the time of signing, and enrolled in the particular political party. Thus, it concluded that as the 27 disputed signers were eligible to vote in the Spring Valley village primary election, and there was no evidence of fraud by Gross, his petition was granted entirely.
