Mintz & Gold has sued its insurer, alleging it wrongly denied the firm business interruption coverage related to Hurricane Sandy and then took part in mediation with no intention to settle. The firm alleges breach of contract and deceptive business practices and demands unspecified damages, punitive damages, interest and attorney fees from Continental Casualty Company, also known as CNA, and National Fire Insurance of Hartford, a CNA company.

The complaint in Mintz & Gold v. CNA, 157221/2013, in Manhattan Supreme Court, says the law firm was unable to operate after the Oct. 29 storm until Nov. 5, claiming its office at 470 Park Avenue South lost power, causing its server to shut down and preventing employees from working remotely. The firm said police and building management denied access to the office so the firm could not obtain the server.
