ESTATE OF MARIANO VILLARONGAFELICIANO, ALSO KNOWN AS MARIANO VILLARONGA, Deceased (1055/13) — In this application by one of the decedent's daughters for the issuance of limited letters of administration, consents were filed by the decedent's spouse and three of the decedent's six children, and two other children who did not execute waivers and consents were served with process and defaulted. Another son under a disability due to his incarceration wrote a letter to the court dated May 25, 2013 requesting, inter alia, an opportunity to appear before the court to object to the appointment of the petitioner as estate representative. Although the court notified the incarcerated distributee by letter dated June 17, 2013 that any objections must be presented in a formal application on notice to all interested parties, no objections were filed to date. Accordingly, the application is granted, and letters of administration limited pursuant to SCPA 702 (1) shall issue to the petitioner.
