A federal court judge has toppled a Bronx murder conviction on the grounds that defense counsel failed to recognize that the jailhouse informant who provided key testimony was an agent of the police.
Southern District Judge Robert Sweet (See Profile) granted Patrick Smith, who is serving a 25-year-to-life sentence for the murder of an armored car guard, a writ of habeas corpus.
