The African Diaspora Maritime Corporation (ADM), a black sailing organization, has asked for an injunction stopping the America's Cup race from taking place this September, claiming that San Francisco's Golden Gate Yacht Club (GGYC), which is in charge of the race, failed to consider in good faith ADM's application to compete. ADM sued GGYC in 2011 claiming it withheld information about the application process and ultimately rejected ADM on various false pretexts. ADM alleges GGYC favored Team Oracle Racing, the current America's Cup champion. Team Oracle is owned by Larry Ellison, founder of software company Oracle Corp., who is also a member of GGYC.

Manhattan Supreme Court Justice Barbara Kapnick (See Profile) dismissed the case in January, but an Appellate Division, First Department, panel revived it last month. On July 17, ADM filed court papers asking for a preliminary injunction blocking the race, arguing it would be irreparably harmed if the race were allowed to go forward.
