A Staten Island lawyer who created a fake profile for a woman he knew without her consent on a lesbian dating website has been suspended for one year by the Appellate Division, Second Department. But the lawyer, James E. O'Hare, has already been suspended for more than a year and can apply for reinstatement immediately.

O'Hare, once an attorney with New York City's Administration for Children's Services, was arrested in 2011 (NYLJ, Feb. 8, 2011). He pleaded guilty that March to attempted aggravated harassment, a Class B misdemeanor. He received a one-year conditional discharge and an order of protection was issued against him. He was suspended by the Second Department in December 2011. Representing himself in the disciplinary proceedings, O'Hare sought a private reprimand for what the court said was a "serious crime," along with the lifting of his suspension.
