Saint Angel appealed from three judgments of the Justice Court which convicted him, upon jury verdicts, of criminal possession of a forged instrument and offering a false instrument for filing. He argued the felony complaint was not properly reduced, among other things. The panel noted the claim that procedures under Criminal Procedure Law §180.50 for reducing felony charges to misdemeanors were not followed were not preserved for appellate review. Yet, after a reconstruction hearing, it found the facts asserted in the instrument supported the lesser charge and the justice court's annotations, including the date of reduction, that the felony was replaced by a proper misdemeanor charge, and that it was the justice's intention to reduce the felony to a misdemeanor, established sufficient compliance with the statute's requirements. Hence, whatever technical deviations there may have been from those requirements were not preserved for appellate review. It also found the informations were facially sufficient noting Saint Angel's acknowledgment, that documents submitted to further his application for employment with the State Police were forgeries, was evidence of his consciousness of guilt. Thus, the judgments of conviction were affirmed.
