With the delayed trial of Gigi Jordan, who is accused of killing her autistic son, her attorneys are making a renewed push for bail and will argue Tuesday that 3 1/2 years of pretrial incarceration, with no end in sight, is a violation of her due process rights.

Last month, Manhattan Supreme Court Justice Charles Solomon (See Profile) acknowledged that the scheduled Sept. 16 trial date is no longer feasible as he grapples with a slew of lengthy motions addressing discovery issues and allegations of prosecutorial misconduct. In papers submitted to the court on Monday, the defense blames the Manhattan District Attorney's Office for the delay, but suggests that no matter who is to blame, Jordan is the casualty in what seems to be perpetual warfare between the advocates.
