ESTATE OF ANTHONY J. CASCARDO, a/k/a ANTHONY JOHN CASCARDO, Deceased. (349/08) — This probate proceeding was tried before a jury. The framed issues presented to the jury concerned the questions of testamentary capacity and undue influence.

After deliberating, the jury determined that Anthony J. Cascardo had testamentary capacity at the time of the execution of his Last Will and Testament, and furthermore, the execution by Anthony J. Cascardo of the paper dated October 19, 2007, was not caused, or procured by the undue influence of Russell Cascardo. The verdict of the jury is amply supported by the evidence. There is no reason to disturb the verdict of the jury. The motion by objectants for judgment notwithstanding the verdict is denied.
