The Gioconda Law Group (GLC) utilizes the Internet domain name GIOCONDALAW.COM. It accused Kenzie of cybersquatting, trademark infringement, false designation of origin, and unlawful interception and disclosure of electronic communications based on his registration of the GIOCONDOLAW.COM domain name so as to enrich himself by intercepting electronic communications intended for GLC. Challenging poverty claims by Kenzie, unemployed since January 2008, GLC contended that Kenzie—claimed to be a recidivist cybersquatter who seeks to promote his own "security services" for profit by registering many domain names intended to imitate the names of established businesses and law firms—spent more than $10,000 in order to register more than 1,000 Internet domain names. The court denied Kenzie’s application for an expert witness appointment under Federal Rule of Evidence 706. Kenzie did not show how the issue of his alleged violation of federal and state laws proscribing cybersquatting, trademark infringement and the interception and disclosure of electronic communications were either "complex or esoteric" or beyond the ability of the trier of fact to understand.
