Bald was sentenced to 15 months in prison, and three years’ federal supervised release, after he pleaded guilty to conspiring to possessing and distributing oxycodone. A mandatory condition of supervisionwhich commenced Nov. 16, 2012required that Bald "not commit another federal, state or local crime." A Jan. 3, 2013, petition charging Bald with state law crimes of third-degree criminal mischief, petit larceny, obstructing governmental administration and possessing burglar tools arose from a police response to a 911 call complaining that unknown persons were breaking into a car in the early morning hours of Dec. 21, 2012, during which time police officers found Bald and an accomplice fleeing the area. A witness identified Bald as one of the individuals responsible for the break-in. When arrested Bald’s accomplice possessed two screwdrivers. Following a hearing, the court found, by a preponderance of the evidence, that through his own conduct and as an aider and abettor Bald was guilty of the four charges set forth in the Jan. 3, 2013, petition. Thus, Bald violated the mandatory condition of his supervised release that he not commit another federal, state or local crime. He is to be sentenced on June 11.
