A composer whose three-act oratorio was cut short by the Brooklyn Philharmonic so the players would not go into overtime can go ahead with a lawsuit against the orchestra, a state judge has ruled.
Brooklyn Supreme Court Justice David Schmidt (See Profile) on May 6 denied the orchestra’s motion for summary judgment on a breach of contract claim in Currier v. Brooklyn Philharmonic Symphony Orchestra, 7661/09. He granted summary judgment against a separate breach of covenant of good faith and fair dealing claim.
