The state’s highest court said yesterday it will hear an appeal into whether the trial records of a criminal case against Brooklyn attorney Seth Rubenstein should be released to the Commission on Judicial Conduct.

Rubenstein became a subject of the commission’s interest during its investigation of Manhattan Surrogate Nora Anderson (See Profile) and the $100,000 donation and $150,000 loan she accepted from Rubenstein, her former boss, during her 2008 election. The legal limit for individual donations was $33,100.
