ALBANY – Prison officials violated the constitutional due process rights of a hobbled inmate by not helping him get to a disciplinary hearing after he was found with three ibuprofen tablets in his cell, a state appeals court has ruled.
In two other unanimous decisions involving inmate grievances, the Appellate Division, Third Department, ruled that prison administrators improperly required inmates to prove their heritage in order to practice their American Indian faith and upheld the punishment of an inmate who devised a phony "cancellation fill-in form" after a visit with his wife fell through because of bad weather.
