ESTATE OF CEDRIC WAYNE WYNTER; Deceased (49/13) — On the return date of process in this application by an alleged creditor for the issuance of limited letters of administration to the Public Administrator, there was no appearance in opposition by the decedent's two distributees, and the petitioner and the Public Administrator entered into a stipulation which was so ordered by the court. The terms of the stipulation provide, inter alia, that if no eligible distributee filed a petition for letters of administration within a certain period of time, the Public Administrator consents to receive limited letters of administration for the sole purpose of being served with process in a pending foreclosure action without any obligation to defend or file an answer in that proceeding.

The period of time for any eligible distributee to file a petition has now expired without any other petition being filed. Accordingly, the application is granted and letters administration shall issue to the Public Administrator as limited by the terms of the parties’ stipulation upon qualifying according to law.
